Official Rules and Regulations

NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

  1. SPONSOR: GOOD Magazine LLC, referred to herein as the "Sponsor."
  2. ELIGIBILITY: The GOOD Magazine – Project 011 (the "Contest") is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry and who have Internet access during the Entry Period (as defined below). Employees, members of their immediate family, or any household member of the Sponsor, its respective company parents, affiliates, subsidiaries, advertising and promotion agencies, and any other person or entity involved in the design, execution or judging of the Contest are not eligible to enter or win. All applicable federal, state and local laws and regulations apply. Void where prohibited or restricted by law.
  3. CONTEST PERIOD: Between 12:01 a.m. ET on May 30, 2008, and 11:59 p.m. ET on August 11, 2008 (the "Entry Period"), visit http://www.goodmagazine.com/section/Projects/project_011 (alternatively referred to herein as the "Site") and follow the link to the Contest site and subsequent directions to first register and then correctly upload your video entry. Submissions (as defined below) not meeting the subject matter criteria shall not be considered. The Sponsor may choose to accept or reject your Submission based on its sole judgment. Prize Winners will be notified via email or telephone. Sponsor is the administrator of the Contest and Sponsor’s computer is the official clock for the Contest. All Submissions become the property of the Sponsor and shall not be acknowledged or returned.
  4. CONTEST SUBMISSION: (a) Contest Details: During the Entry Period, create your own video and submit it to the Contest (the "Submission"). Visit http://www.goodmagazine.com/section/Projects/project_011 to enter your Submission into the Contest. (b) Submission Requirements:
    • The following file types are accepted for video entries: .wmv; .mov; .avi; .mpg; .mpeg; .mp4; .asf; and .3gp
    • Must not exceed 100MB in size
    • Must not exceed two (2) minutes in length
    • Must comply with all Content Restrictions (as defined below).

    (c) Upload Phase: Go to http://www.goodmagazine.com/section/Projects/project_011 and follow the links and instructions for submission. All individuals who desire to participate in the Contest must first register in order to upload Submissions and thereby be an eligible participant ("Participant"). During the registration process, each Participant shall be required to click where indicated to confirm that such Participant agrees to be bound by these Official Rules and Regulations ("Official Rules"). Any Submission that includes content which is deemed inappropriate, indecent, obscene or otherwise does not comply with the Content Restrictions listed in Section 5 below, as determined by the Sponsor in its sole discretion, shall not be eligible. The Sponsor shall have the right to copy, edit, modify, adapt, distribute, display, perform and publish any or all of the Submissions, and may use them in any media without attribution or compensation to the Participant, his or her successors or assigns, or any other entity. ENTERING A SUBMISSION IN THIS CONTEST CONSTITUTES PARTICIPANT'S IRREVOCABLE ASSIGNMENT, CONVEYANCE, AND TRANSFERENCE TO THE SPONSOR OF ALL RIGHT, TITLE, AND INTEREST IN THE SUBMISSION, INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHTS. The Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected Submissions, which are void. In addition, by entering, Participants represent and warrant that the Submissions that they submit are their own original creations, do not infringe any other person's or entity's rights, have not been submitted previously in a contest of any kind, and that they have obtained permission from all people featured or appearing in the Submission to enter this Contest.

    (d) Limit: Each Participant may enter ONLY one (1) submission during the Entry Period. Multiple Participants are not permitted to share the same email address. Any attempt by any Participant to enter more than one (1) Submission by using multiple/different email addresses, identities, registrations, or any other methods shall void all Submissions entered by that Participant and that Participant, at the sole discretion of the Sponsor, may be disqualified. Use of any automated system to participate is prohibited and shall result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register shall be deemed to be the registrant or Participant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. A Participant may be required to show proof of being the authorized account holder.

  5. CONTENT RESTRICTIONS: Your Submission must NOT contain:
    • Nudity;
    • Material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights;
    • Images and/or artwork that are copyrighted, trademarked, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material;
    • Gratuitous violence;
    • Dangerous stunts;
    • Real weapons of any kind, including but not limited to guns, knives or projectiles;
    • Drug use;
    • Material that is hateful, tortuous, defamatory, slanderous or libelous;
    • Material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other basis protected by Federal, State, or Local Law, Ordinance, or Regulation; and
    • Material that is unlawful, in violation of or contrary to the laws or regulations in any state where the Submission is created.

    Failure of any Submission to comply with the above restrictions (collectively, the "Content Restrictions"), as determined by the Sponsor in its sole discretion, shall result in disqualification. The Sponsor may, at its sole discretion, disqualify a Participant from participating in any aspect of the Contest, if the Sponsor deems or suspects that such Participant has engaged directly or indirectly in, or has attempted to engage in any of the following: (a) acting in violation of the Official Rules, or any terms and conditions relating to use of or access to the Site; or (b) submitting a Submission that the Participant has not personally authored (submitting someone else's work); or (c) damaging, tampering with or corrupting the operation of the Contest; or (d) acting with intent to annoy, harass or abuse any other person; or (e) any unsportsmanlike, inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, or unusual behavior or activity; or (g) activity deemed in the sole discretion of the Sponsor and its agents to be generally inconsistent with the intended operation of the Contest. Any person attempting to deliberately damage or corrupt the Contest website or undermine the operation of the Contest will be subject to immediate disqualification and may also have violated criminal and civil laws. Should such an attempt be discovered, the Sponsor and its agents reserve the right to prosecute and seek damages from any such individual to the fullest extent of the law.

  6. JUDGING/REQUIREMENTS OF CONTEST WINNER: Following the Entry Period, qualified judges chosen by the Sponsor (the"Judges"), shall choose the potential winners from all eligible submissions based on the following criteria: 40% entertainment of the Submission; 30% originality of the Submission; and 30% creativity of the Submission. When registering their submission, all Participants must provide an author field, valid e-mail address and telephone number. Notification of the winner will occur within fourteen (14) days following the Entry Period. Any attempt to contact a potential winner via either e-mail and/or telephone which is unsuccessful due to the prize notification being either returned as undeliverable or the provided telephone number being incorrect or no longer in service, may result in disqualification and an alternate winner will be selected solely at the Sponsor's discretion. The decisions of the Judges in all and any matters related to the Contest shall be final and binding. The winner will be required to complete and return certain Affidavits of Eligibility, Tax Releases, and Name and Liability Releases, as well as complete and return a 1099 form based on the average retail value ("ARV") of the prize they have been awarded. Failure to return these documents in a timely manner, as determined by the Sponsor, may result in disqualification and an alternate winner will be selected. The winner is solely responsible for the reporting and payment of all federal, state and local taxes (if any). The Sponsor reserves the right to substitute any prize(s) of like value in the event that the described prize(s) is unavailable for any reason whatsoever. No cash redemptions or transfer of prizes are permitted. By entering the Contest all Participants agree to be bound by these Official Rules. Acceptance of any prize shall constitute and signify the winner's agreement and consent that the Sponsor shall have the right to use the winner's name, address (only city and state), likeness, and/or prize information for contextual purposes worldwide, including the Internet, without limitation and without further payment or consideration, expect where prohibited by law.
  7. PRIZES: Each prize consists of two (2) Travel Certificates. Each Travel Certificate is redeemable for round-trip coach air transportation travel for one (1) passenger on JetBlue Airways between any two (2) cities in the JetBlue Airways route network.

    Total Approximate Retail Value of Travel Certificates is five hundred ninety-eight dollars ($598.00). Actual value of Travel Certificates may vary based on airfare fluctuations and distance between departure and destination.

    Travel Certificates are valid for one (1) year from date of issuance, and all travel must be completed on or before the expiration date as it appears on each Travel Certificate. Redeemed travel is subject to availability and seats may not be available on all flights. Travel may be capacity controlled and space is limited. Certain restrictions and blackout dates may apply, which may include a Saturday night stay, all of which are subject to change at the sole discretion of JetBlue Airways. Schedules are subject to change without notice. JetBlue Airways is not liable for any expenses incurred as a consequence of a flight cancellation or flight delay. Passengers are solely responsible for obtaining all necessary documentation, travel authorizations, and travel insurance, if any. JetBlue Airways reserves the right to deny boarding to passengers without the proper documentation. Passengers are solely responsible for any applicable fees, service charges, surcharges or passenger facility charges, and all insurance, federal, state and local taxes, if any, and any other unspecified expenses associated with acceptance or use of Travel Certificates, including without limitation all meals, air and ground transportation, personal incidentals, and gratuities. Travel Certificates are transferable; however, at no time may Travel Certificates be transferred without prior consent from JetBlue Airways. Travel Certificates are not redeemable for cash, and may not be sold, bartered, traded, or otherwise exchanged for value, including but not limited to in transactions on eBay or other online auction websites. Redemption of Travel Certificates at a JetBlue Airways airport ticket counter is not allowed. Loss of Travel Certificate authorization number and/or PIN cannot be replaced. Redeemed travel is not eligible for TrueBlue points and may not be used toward the purchase of a JetBlue Getaways Vacation Package or a JetBlue Cruise. TrueBlue is JetBlue Airways’ flight gratitude program. Passengers using Travel Certificates are subject and entitled to all provisions of the JetBlue Airways Contract of Carriage, except denied boarding compensation and the Passenger Bill of Rights. The JetBlue Airways Contract of Carriage is posted on the Sponsor’s website at http://www.jetblue.com/p/jetblue_coc.pdf. Use of Travel Certificates is subject to additional terms and conditions, and other restrictions may apply.

  8. GENERAL RULES: By entering or participating in the Contest, Participants agree to be bound by these Official Rules. The Sponsor does not assume any responsibility for electronic hardware, programming or software malfunctions, or failures, or line connections, accessibility or availability, or technical failures of any kind, or unauthorized human intervention, or the incorrect or inaccurate capture of any Submission or other information, or for the failure to capture any such information. The Sponsor is not responsible for: (1) any incorrect or inaccurate information, whether caused by Participants, or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Submission process or the Contest; or (4) technical or human error which may occur during the administration of the Contest or the processing of the Submissions. Further, if for any reason the Contest is not capable of running as planned by reason of infection by virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of the Sponsor, may corrupt or effect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right, at its sole discretion, to cancel, delay, terminate, modify or suspend the Contest, and select the winner from the Submissions received prior to the action taken or in other such manner as deemed fair and appropriate by the Sponsor. In the event of cancellation, delay, termination, modification or suspension of the Contest, the Sponsor shall post a notice to such effect on the Site.

    Each Participant, by participating in this Contest, hereby waives and releases, and agrees to hold harmless, the Sponsor, and all contest and advertising agencies, and their respective parents, subsidiaries, affiliates, and distributors, and all of their respective officers, directors, shareholders, employees, representatives and agents (collectively, "Indemnified Parties"), from and against, any and all rights, claims and causes of action whatsoever that such Participant may have, or which may arise, against any Indemnified Parties for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from such Participant's acceptance, possession, use or misuse of the prize in the Contest, or such Participant's participation in the Contest, or his or her participation in any Contest or prize related activity, or any travel related to the Contest or any travel for any prize related activity. Each Participant also further acknowledges that the Indemnified Parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law relative to any prize or this Contest including but not limited to quality, condition or fitness for a particular purpose. Except where prohibited, each Participant agrees that any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved under the laws of the State of California, without respect to any conflict of law issues.

    The Sponsor is not responsible for any typographical or other errors in the offering or announcement of prizes, in the Official Rules, or in the administration of the Contest, or any inaccurate or incorrect data contained on the Site, or any personal injury or property damage or losses of any kind which may be sustained to any Participant's or any other person's computer equipment resulting from participation in the Contest, or use of or download of any information from the Site. Use of the Site is at each Participant's own risk. WITHOUT LIMITING THE FOREGOING, THE SITE AND ALL MATERIALS PROVIDED THROUGH OR IN CONNECTION WITH THE SITE ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES; CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS REGARDING THESE LIMITATIONS OR RESTRICTIONS. The Sponsor does not make any, and hereby disclaims any and all, representations or warranties of any kind regarding any prize. All potential winners, on behalf of themselves, their executors, employers or companies, heirs and assigns, by acceptance of a prize, agree to release the Sponsor and its affiliates, officers, employees and subcontractors from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses of any kind to persons or property which may be sustained in connection with the receipt or use of any prize, or while preparing for or participating in the Contest, or any activity in connection with the Contest or otherwise. The Sponsor reserves the right to amend these Official Rules at any time, including without limitation, as necessary to comply with any applicable law or regulation. The Sponsor may, in its sole discretion, take whatever measures the Sponsor deems necessary or appropriate to preserve the integrity of the Contest.
